The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interoperating and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative actions are not permitted. The parties agree that a party may bring claims against the other only in each’s individual capacity, and not as a plaintiff or class member in any putative class, collective or representative proceeding, such as the form of a private attorney general action against the other. Further, unless both you and the Patawomeck Indian Tribe Of Virginia agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

PAYMENT POLICY
Payment is due at the time the products or services are purchased from the Patawomeck Indian Tribe of Virginia, Inc, The Patawomeck Tribal Store or related events (both in-person and online).
RETURNS & REFUNDS POLICY
Thank you for shopping at the Patawomeck Indian Tribe of Virginia’s Tribal Store. The Tribe is committed to providing products of high quality and value to its customers.
If you are not entirely satisfied with your purchase, we’re here to help. You may return your purchase within 30 days of the ship date with original packaging. No restocking fees apply!
Returns and exchanges are accepted only for items purchased from the Patawomeck Tribal Store. Refunds will be applied based on the original method of payment.

Returns
You may return an item within 30 days of delivery for a full refund. To be eligible for a return, your item must be unused and in the same condition that you received it. If you need to return an item, please Contact Us with your order number and details about the product you would like to return. We will respond with instructions for how to return items from your order.
To return your product for a refund, you will be responsible for paying for your own shipping costs. Shipping costs are non-refundable. If you are shipping an item over $50, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your return item.
We’ll pay the return shipping costs if your item arrived with damages incurred during shipping. If you believe that your order is received damaged or broken, please take a photo of the original packaging (including the box the order was shipped in) so we may follow up with our shipper, if needed.

Exchanges
For exchanges, you will be responsible for paying for your own shipping costs. Shipping costs are non-refundable. If you are shipping an item over $50, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your return item.
Items can be exchanged for a product of equal value. However, if the item being exchanged is less than the item being requested, the difference in the value of the items will be charged to the customer at the time of the exchange request. If the item being exchanged is greater than the item being requested, the difference in the value of the items will be refunded to the customer once the return item has been received by the Patawomeck Tribal Center. The customer will receive this refund in the same method of original payment.

Refunds
Once we received your item, we will issue a refund using the same method as the original. Returns without a receipt or items purchased with a gift card, will be refunded as merchandise credit.
Non-refundable items include products containing food items, ‘as is’ or ‘final sale’ items, and gift cards.
You should expect to receive your refund within 2 weeks of us receiving your item(s) back; however, in many cases you will receive a refund more quickly. This period includes the time it takes for us to process your return, once we have received it (3 to 5 business days), and the time it takes your bank or credit card company to process our refund request (5 to 10 business days).

GIFT CARD POLICY
Your use of any gift card constitutes acceptance of these terms and conditions:
Your gift card is redeemable at the Patawomeck Tribal Store only. Present this card as payment for your purchases or indicate the Card number for online purchases. The purchase amount will be deducted from the Card amount until the value of the Card reaches zero. This Card is not redeemable for cash or for the purchase of other Cards, is non-transferrable, and the unused value remains on the Card. This is not a credit/debit card and has no implied warranties. Treat this card as cash; if it is lost, stolen or damaged, it will not be replaced. If found, please return this card to the Patawomeck Tribal Center.

SHIPPING POLICY
We ship all in-stock items within 2 weeks depending on holidays, weekends, mail traffic and other conditions; however, in many cases you will receive your order more quickly. When your purchases are shipping through standard USPS methods, please expect up to 3-5 days for delivery.

A shipping/handling fee will be applied based on the total of an order. The rates are as follows:

Any shipping information provided within a product description overrides the information provided by the shipping chart.

If the actual shipping charge is considerably more than indicated when you purchase an item, we will contact you prior to charging your card.

Our Shipping/Handling Rates include appropriate materials and careful packing to get your item to you safely, as well as the appropriate insurance for their value.

Please provide us with a physical address and phone number to deliver your package. We do not ship parcels to post office boxes.

An e-mail address is not required to place your order. However, providing an e-mail address will result in better options for communications with a shipper in the event that there is a problem with deliver.
TAX POLICY
We charge sales tax on all merchandise sold at the Patawomeck Tribal Center and on the Patawomeck Tribal Store (online) that is considered taxable as required by law. Currently, we do not sell any merchandise that is considered non-taxable. Tax is not included in the purchase price. Sales tax is added to your purchase at checkout.
